Welcome to DONE Watches! The terms "we", "our" and "us" refer to DONE Watches Sàrl. DONE Watches operates this store and website, including all associated information, content, features, tools, products and services, in order to provide you, as a customer, with a personalised shopping experience (the "Services"). DONE Watches uses the Shopify platform, which enables us to offer you the Services.

The terms and conditions below, together with the policies referenced therein (the "Terms of Use" or "TOU"), describe your rights and responsibilities when using the Services.

Please read these Terms of Use carefully, as they contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not accept these Terms of Use or the Privacy Policy, you must not use or access our Services.

ARTICLE 1 - ACCESS AND ACCOUNT

By accepting these Terms of Use, you declare that you have reached the age of legal majority in your state or province of residence and you give us your consent to allow your minor children to use the Services on devices you own, purchase or manage.

To use the Services, including to access or browse our online stores or to purchase any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and delivery information. You represent and warrant that all information you provide in our stores is accurate, current and complete, and that you have all necessary rights to share such information.

You are solely responsible for the security of your account credentials and any activity associated with your account. You are not permitted to transfer, sell, assign or sublicense your account to another person.

ARTICLE 2 - OUR PRODUCTS

We have made every effort to accurately represent our products in our online stores. Our photographs and descriptions faithfully reflect the quality and appearance of our products as manufactured and delivered. However, certain colours or shades may appear slightly different depending on screen type and display settings. These technical variations are beyond our control and do not in any way affect the quality of the product received.

All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to withdraw any product from sale at any time and may limit the quantities of products we offer to a person, geographic area or jurisdiction, on a case-by-case basis.

ARTICLE 3 - ORDERS

When you place an order, you are making an offer to purchase. DONE Watches reserves the right to accept or decline your order, for any reason, at its discretion. Your order is only considered accepted upon written confirmation from DONE Watches. We must receive and process your payment before your order is validated.

Please review your order carefully before submitting it, as DONE Watches may not be able to accept cancellation requests once an order has been confirmed. Any request for modification or cancellation must reach us within 24 hours of the order being placed, before dispatch, at info@donewatches.ch with your order number.

In the event of refusal, modification or cancellation of your order, we will attempt to contact you using the email address, billing address and/or phone number provided at the time of ordering.

Your purchases are subject to the return or exchange conditions set out in our Refund Policy.

You represent and warrant that your purchases are intended for personal or domestic use, and not for commercial resale or export.

ARTICLE 4 - PRICES AND BILLING

Prices are displayed in Swiss francs (CHF). For deliveries to Switzerland, the United Kingdom and the European Union, prices are displayed inclusive of all taxes (VAT included), including VAT and any customs duties, covered by DONE Watches. For all other destinations, prices are displayed exclusive of local taxes and customs duties, which remain the sole responsibility of the Customer.

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time of the order and will be stated in the confirmation email.

You agree to provide complete and accurate purchase and delivery information for all purchases made in our stores. You undertake to promptly update your information, including your email address and delivery address, so that we can complete your transactions and contact you if necessary.

ARTICLE 5 - PAYMENT

DONE Watches accepts the following payment methods: Visa, Mastercard and American Express credit cards, PostFinance Pay and TWINT. All payments are processed securely through our partner Wallee. DONE Watches does not store any banking data.

In the event of non-payment or late payment, DONE Watches reserves the right to apply reminder fees or, as a last resort, to engage a debt collection agency.

ARTICLE 6 - SHIPPING AND DELIVERY

DONE Watches ships its orders from Cormondrèche, Switzerland, in carefully designed and secure packaging, with signature upon delivery, via the following carriers:

Within Switzerland: Swiss Post, delivery within 2 to 3 business days
Internationally: FedEx, delivery within 3 to 10 business days depending on destination

Delivery is free for all watches, worldwide. For accessories, delivery is free within Switzerland and for all international orders from CHF 200.-. Below this amount, a shipping fee of CHF 25.- applies.

Orders delivered to Switzerland, the United Kingdom and the European Union are sold inclusive of all taxes, covered by DONE Watches. For other destinations, local customs fees may apply upon receipt and remain the responsibility of the recipient.

All delivery times indicated are estimates and are not guaranteed. DONE Watches accepts no liability for delays caused by carriers, customs formalities or any event beyond its control.

In the event of loss or damage noted upon delivery, contact us immediately at info@donewatches.ch. We will do our best to find the most suitable solution with the carrier.

ARTICLE 7 - AVAILABILITY

Product offers are valid subject to available stock. If an ordered item becomes unavailable, the Customer will be informed as soon as possible. DONE Watches will then offer a revised delivery timeframe, an exchange or a full refund according to their preference.

ARTICLE 8 - RIGHT OF RETURN (30 DAYS)

The Customer has 30 days from receipt of their order to return an item. To be accepted, the return must meet the following conditions: item unworn, with no signs of use, kept in its original packaging with the case and all accessories included.

DONE Watches does not accept the return of engraved, personalised or modified items.

Before any shipment, the Customer must contact DONE Watches at info@donewatches.ch in order to agree on the best return solution together. Return shipping costs and any customs fees related to the return are the sole responsibility of the Customer. DONE Watches recommends using a tracked and insured shipping service.

The refund is processed within 5 to 10 business days after receipt and verification of the returned item, to the payment method used at the time of the order.

ARTICLE 9 - WARRANTY

Each DONE Watches timepiece benefits from a 2-year international warranty from the date of receipt, covering any manufacturing defects under normal conditions of use.

The Customer must inspect the delivered goods upon receipt of the parcel in order to identify any material defects, obvious manufacturing faults or transport damage.

Any warranty service must in principle be carried out by the DONE Watches workshops in Cormondrèche. However, for customers located outside Switzerland, DONE Watches may, at its discretion and with prior written agreement, authorise an intervention by a qualified local watchmaker. In such cases, the warranty remains valid provided the intervention has been expressly approved by DONE Watches. Any intervention carried out by a third party without prior agreement from DONE Watches automatically voids the warranty.

The following are not covered by this warranty:

Damage caused by impacts, misuse or failure to follow the instructions for use
Normal wear of the watch and the natural ageing of materials over time
Sapphire crystal breakage and wear on anti-reflective coatings
Alteration of surface treatments (PVD, Hyceram) due to use
Strap wear, regardless of material. Only manufacturing defects noted upon receipt and reported within 48 hours may be covered
Indirect or consequential damages resulting from the use or malfunction of the watch

For any warranty claim, the Customer must contact DONE Watches at info@donewatches.ch describing the problem and attaching photographs where possible. DONE Watches will assess each situation individually and propose the most appropriate solution.

ARTICLE 10 - PROMOTIONAL OFFERS

Promotional offers are valid subject to available stock and according to the conditions stated for each promotion. A promotional code must be entered at the time of ordering in the designated field. Promotional benefits are not redeemable for cash. In the event of a partial return of an order benefiting from a promotion, DONE Watches reserves the right to reassess the conditions of application of the offer.

ARTICLE 11 - INTELLECTUAL PROPERTY

Our Services, including without limitation all registered trademarks, marks, texts, displays, images, graphics, videos and audio content, as well as their design, selection and arrangement, are the exclusive property of DONE Watches Sàrl. They are protected by Swiss and international patent, copyright and intellectual property laws.

These Terms authorise you to use the Services for personal and non-commercial purposes only. You are not permitted to reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any material from the Services without prior written consent from DONE Watches.

ARTICLE 12 - OPTIONAL TOOLS

You may have access to tools provided by third parties as part of the Services, tools which we do not monitor and over which we have no control. We provide access to these tools "as is" and "as available", without warranty of any kind. We disclaim all liability arising from your use of optional third-party tools.

ARTICLE 13 - LINKS TO THIRD PARTIES

The Services may contain hyperlinks to websites provided or operated by third parties. We are not responsible for the content or accuracy of these sites. If you choose to leave our site to access third-party sites, we invite you to review their terms of use and privacy policies before any interaction.

ARTICLE 14 - RELATIONSHIP WITH SHOPIFY

DONE Watches is powered by Shopify, which enables us to offer you the Services. Any sale or purchase made in our store is carried out directly with DONE Watches. By using the Services, you acknowledge and agree that Shopify bears no responsibility for any aspect of transactions between you and DONE Watches.

ARTICLE 15 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read and accepted this policy.

ARTICLE 16 - FEEDBACK

If you submit reviews, suggestions or any other content, you grant us a perpetual, worldwide licence to use, reproduce, modify and distribute such content for any purpose, including commercial purposes. You represent that you hold all necessary rights over such content and that it complies with these Terms.

ARTICLE 17 - ERRORS, INACCURACIES AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions or product availability. We reserve the right to correct any errors and to amend information at any time and without notice.

ARTICLE 18 - PROHIBITED USES

You may access and use the Services only for lawful purposes. You are strictly prohibited from accessing or using the Services for unlawful purposes, in violation of any applicable regulations, in a manner that infringes the intellectual property rights of DONE Watches or third parties, or to transmit false or misleading information.

ARTICLE 19 - DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED BY DONE WATCHES, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

ARTICLE 20 - LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DONE WATCHES, OUR PARTNERS, OFFICERS, DIRECTORS OR EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT OBTAINED THROUGH THE SERVICES.

ARTICLE 21 - INDEMNIFICATION

You agree to indemnify and hold harmless DONE Watches and its affiliates, partners, officers, employees and agents from any loss, damage or claim arising from your breach of these Terms of Use, your violation of any law or the rights of a third party, or your access to and use of the Services.

ARTICLE 22 - SEVERABILITY

In the event that any provision of these Terms of Use is found to be unlawful, void or unenforceable, that provision will remain enforceable to the maximum extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms.

ARTICLE 23 - WAIVER AND ENTIRE AGREEMENT

Failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and DONE Watches and govern your use of the Services.

ARTICLE 24 - ASSIGNMENT

You may not transfer or assign this agreement without our prior written consent. Any attempt at unauthorised assignment shall be deemed null and void. DONE Watches may transfer or assign these Terms and its rights and obligations without your consent.

ARTICLE 25 - GOVERNING LAW

These Terms of Use are governed by and construed in accordance with Swiss law. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the ordinary courts of the canton of Neuchâtel, registered seat of DONE Watches Sàrl.

ARTICLE 26 - CHANGES TO THE TERMS OF USE

We reserve the right to update or modify these Terms of Use at any time by posting the changes on our website. Your continued use of the Services following the posting of any changes constitutes your acceptance of those changes.

ARTICLE 27 - INVOICE PAYMENT POWERPAY

MF Group / POWERPAY offers, as an independent payment service provider, the payment method "Invoice Payment". The order invoice allows you to simply pay for your online purchase by invoice. If you fail to make a payment within the allotted time, you will retroactively receive a monthly invoice the following month with an order overview.

Upon conclusion of the purchase contract, POWERPAY assumes the invoice receivable and handles the processing of payment arrangements. By choosing invoice payment, you agree, in addition to our Terms, to the general terms and conditions of POWERPAY.
